Conditions of Use

 • General sales conditions

It is specified beforehand that the present conditions govern the sales, by Duendä, of all the products present on site duenda.org.

These conditions apply other than all other conditions.

All of this website, and all the rights pertaining to it, are the property of Duendä. Any full or partial reproduction thereof is subject to the owners' consent. However, hypertext links to the website are authorised without submission of a specific request.


1. Acceptance of conditions

The customer acknowledges that he has read and understood the special conditions of sale displayed on this screen during the order placement process, and agrees to be bound by them unreservedly.
The present conditions of sale govern contractual relations between Duendä and its customer, and both parties agree to be bound by them unreservedly.


2. Products

The photographs illustrating the products are not within the contract scope. Should the photographs contain errors, Duendä cannot accept any responsibility therefore. Most products that Duendä offers its customers are available from our warehouse.

Our offers of products are proposed within the limit of stocks available. You of the exactitude of your co-ordinates ensure: name, addresses and telephone number. To check at the time of the order, article by article, that the number, the color, the size, the price are well taken into account in your purchase order. When a product is not available any more, this one posts SOLD OUT and it is not possible any more for you to order it. However according to the availability of our suppliers, the product could be again in stock on the site and you will be able if you wish it in being informed by e-mail.

3. Ordering

The automatic recording systems are deemed to be proof of the nature, content and date of the order. Duendä shall confirm acceptance of the customer's order by e-mail to the address provided. The sale shall be concluded only once the order has been confirmed. Duendä reserves the right to cancel any order by a customer with whom it is in dispute in respect of the payment of a previous order. The purchaser is bound by the information he provides when ordering: in the event of the recipient's delivery or contact details being incorrectly provided, the vendor cannot be held responsible for being unable to deliver the goods


4. Delivery

The carrier undertakes by contract with Duendä to deliver the order to the recipient's address provided by Duendä. Delivery times are the carrier's full responsibility, and in no case can Duendä be held responsible for non-compliance with delivery times.
In addition, for deliveries outside mainland , the customer undertakes to settle all product import and customs duties, valued-added tax, and any other taxes due in accordance with the laws of the country of order delivery. Duendä cannot be held legally responsible for non-payment of duties or taxes by the customer.
Orders in mainland are delivered using the tracked service operated by Deutsche Post (German post office). Deliveries are made during the time slot agreed with the carrier, by direct handover of the order to the planned recipient, or if the latter is absent, to another person approved by the customer. Any delays shall not entitle the purchaser to claim compensation.
Deliveries to other EU countries are made by the tracked service operated by Deutsche Post. Deliveries outside the EU are made by the international postal services.
War, rioting, fire, industrial action, accidents and the inability to procure goods are deemed to be force major grounds that discharge the vendor from its obligation to deliver. The goods are always carried at the recipient's risk. Goods should always be checked on delivery. If goods are incomplete or damaged, the customer has 48 hours to notify the carrier thereof. For reasons of availability, an order may be delivered to the customer in several parts. In this case the customer pays only for one delivery. If the customer wishes the order to be delivered to two addresses, he shall place two orders and accordingly pay for two deliveries.


5. Withdrawal

You have seven days (with effect from receipt of the goods) to form an opinion. Should you wish to exchange the goods or obtain a refund, send the new item(s) undamaged in its (their) original packaging(s), with any accessories, to the following address:

Should the customer exercise his right to withdraw, Duendä is bound to refund without costs the amount paid by the customer, except for return carriage costs. The refund shall be paid within 15 days.


6. Price

Prices are stated in euros. All figures in other currencies are for guidance only.
The price stated on the product fact sheets does not include carriage.
The price stated in the order confirmation is final and inclusive of all duties and taxes, and includes VAT for and other EU countries. This price covers the price of the products and the cost of handling, packing, carriage.


7. Payment

All the orders dispatched in are expressed in Euros all inclusive of tax (19% VAT).
The price billed to the customer is the price stated on the order confirmation issued by Duendä. The price of the products is payable on the day the order takes effect.

The order validated by the customer shall take effect only when the relevant bank payment centres have approved it. Should said centres refuse approval, the order shall be automatically cancelled and the customer notified by e-mail. In addition, Duendä reserves the right to refuse any order from any customer with whom it is in dispute.


8. Disputes

The present conditions of sale are governed by German law, and the Nürnberg courts have sole competence in the event of a dispute.


9. Guarantee

The quality of the products cannot be questioned and the customer is solely responsible for his chosen products. Duendä can in no event be held responsible for non-compliance with the regulatory and legislative provisions in force in the recipient's country, and Duendä's liability is systematically limited to the value of the product subject to dispute, as at the date of sale. The customer shall have no recourse against the product's brand or producer.


10. Legal information

The customer must provide the personal details collected for the purpose of distance selling. Said details are essential for the processing and delivery of orders, and for the generation of bills and guarantees. Failure to provide the requisite details shall entail non-validation of the order. In addition, Duendä undertakes not to pass on its customers' personal details to any third party, whether free of charge or in return for payment.
